PRIVACY STATEMENT


At TransUnion Interactive, Inc ("we" or "TUI"), we are committed to protecting your privacy, and support a general policy of openness about how we collect, use and disclose your personal information.

The purpose of this Privacy Statement is to inform you about our practices relating to the collection, use and disclosure of personal information that may be provided through access to or use of our TrueCredit© sites (the "Site") or call centre , or services and related products, or that may otherwise be collected by us. By purchasing or otherwise obtaining our products, using our services or our website, you consent to the collection, use and disclosure of your personal information (as defined below) in accordance with the following terms and conditions.

This Privacy Statement also explains how you can contact us if you have a question about, want to make a change to or delete any personal information that we may be holding about you. We strongly recommend that you take the time to read this Privacy Statement and retain it for future reference.

Personal Information

For the purpose of this Online Privacy Statement, "personal information" means information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization

What Personal Information We Collect

In order to process your transactions and provide you with quality customer service, we collect via the Site, our call centre or otherwise, your name and current address and/or billing address, your email address, telephone numbers and, if you purchase one of our products or services, a valid credit card number, and certain other personal information, such as your date of birth, address information, employment information, and certain credit card and loan account information.

How We Use and Share Your Personal Information

We use your personal information to:
  • Provide you with personalized services and interactive communication;
  • Provide you with timely and reliable services;
  • Verify your identity;
  • Do all the things necessary to administer those services;
  • Research, develop, manage, protect and improve those services;
  • Advise you about new products and services that may be of interest to you;
  • Develop and maintain our relationship with you and communicate with you;
  • Bill you for our products and services;
  • Collect outstanding debts;
  • Assist in the investigation of a contravention of a law;
  • Assist in the detection of fraudulent activities; and
  • Act in respect of an emergency that threatens the life, health or security of an individual.
When We Disclose Your Personal Information

Except with your consent, we will not sell, license, trade or rent your personal information to or with others.

We share personal information with TransUnion of Canada, Inc. ("TransUnion") for the purpose of providing you with the products and services and, in addition, may share personal information with other third parties engaged to assist us in providing the services to you or to carry out one or more of the purposes described above. These service providers are prohibited from using your personal information for any purpose other than to provide this assistance and are required to protect personal information disclosed by us and to comply with the general privacy principles described in this Privacy Statement. Some of these service providers are located outside of Canada as we are. As a result, your personal information may be subject to local laws, which may be different from Canadian laws.

We reserve the right to disclose personal information to a third party if a law, regulation, search warrant, subpoena or court order legally requires or authorizes us to do so.

We also reserves the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal or financing of all or any portion of TUI or of any of the business or assets or shares of TUI or a division thereof in order for you to continue to receive the same products and services from the third party.

Knowledge and Consent

We collect personal information about you only when you voluntarily provide it. Typically, we will seek consent for the use or disclosure of your personal information at the time of collection, such as at the time of enrolment via our Site. Please be advised that your agreement to this Privacy Statement on our Site at the time of enrolment will extend to the collection of any personal information collected via our call centre during the course of any transactions you may conduct or inquiries you may have, using that channel. In certain circumstances, consent may be sought after the information has been collected but before use (for example, when we want to use information for a purpose not previously identified). The form of consent that we seek, including whether it is express or implied, will largely depend on the sensitivity of the personal information and the reasonable expectations of the individual in the circumstances.

You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. If you wish to withdraw your consent at any time, please contact Consumer Relations at 1-800-508-2597 We will inform you of the implications of withdrawing consent and instructions on how to do so.

We will not, as a condition of the supply of a product or service, require you to consent to the collection, use or disclosure of information beyond that required to fulfill the explicitly specified and legitimate purposes for which the information is being provided.

Use or Disclosure for Marketing Purposes

If you have not opted out of receiving marketing materials, TransUnion and its affiliates may also collect and use (but will not disclose) your personal information for marketing and promoting goods, services and special offers, including by means of direct marketing. TransUnion may use your personal information, including financial information, to evaluate your eligibility for special offers made by ourselves and our third party business associates (namely, financial institutions, telecommunications companies, retailers, insurance companies, real estate companies). TransUnion may also disclose your non-sensitive personal information (eg. name and mailing address) to our third party business associates so that they can send you marketing and promotional materials directly as well.

You can choose not to allow TransUnion to use or disclose your personal information for direct marketing purposes by indicating your preference on the Opt In consent box or by contacting us as outlined below (see "Contacting Us").

Cookies

We use "cookies", which are pieces of information that a Site transfers to your computer’s hard disk for record keeping purposes, to facilities your access to our products and services. We use cookies in accordance with industry-standard protocols and do not use cookies, either directly or in conjunction with other websites, to track your movement to websites other than our own. If you would like more information about cookies, you can visit http://www.cookiecentral.com/n_cookie_faq.htm. We use two different types of cookies. One type of cookie is used so that our site "recognizes" you each time you return using the same computer, and you do not have to re-enter all your personal information on each visit. You can set your Web browser to refuse to accept these cookies, or delete this type of cookie from your hard drive, and still access our products and services, as long as you re-enter information each time you visit. The second type of cookie is needed so that we can process each step of your transactions with us. If you refuse to accept this type of cookie, you will not be able to access our products and services. Most Web browsers automatically delete this type of cookie when you terminate your session.

We may use third-party advertising companies to serve ads on our site. These companies may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous. IP Addresses and Server Logs

Unique Internet Protocol (IP) addresses are assigned to all Internet users by their Internet Service Providers (ISPs). IP addresses do not directly identify Internet users; however, through an ISP, an IP address may be linked to a particular user.

During a visit to a website, certain information about a user's traffic patterns, linked with the user's IP address, is passively and automatically collected in the normal course of establishing and maintaining a website connection. This information is logged by the web server of the website that is visited.

The following information is logged by our web servers during visits to our Site: IP addresses, type of operating system, time and duration of visit, web pages visited and browser type. We do not link server log information to any other information in a way that would enable the identification of visitors to our Site. Server log information is analyzed by us in order to improve our Site and to customize the Site for users. In addition, from time to time, server logs may be reviewed for security purposes; for example, to detect unauthorized activity on our Site. In such cases, server log data, containing IP addresses, would be shared with law enforcement bodies in order that they may identify users in connection with their investigation of the unauthorized activities.

How We Protect Your Personal Information

We take precautions to secure your personal information. Access to information is also restricted to selected employees or representatives. If and when we ask you to provide your personal information, we will do so through a Web page that uses the Secure Sockets Layer (SSL) protocol. This protocol provides security for your information by encrypting it as it travels from your computer to our computer. For security purposes we then move all of the personal information that we collect or obtain about you, including your credit report, to an environment on our proprietary network that has controls in place to limit access to and secure the data maintained therein.

Links to Third Party Sites

This Site may offer links to other third party websites. You should be aware that operators of linked websites may also collect your personal information (including information generated through the use of cookies) when you link to their websites. TUI is not responsible for how such third parties collect, use or disclose your personal information, so it is important to familiarize yourself with their privacy policies before providing them with your personal information.

Retention of Your Personal Information

TUI retains your personal information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws, and your consent to such purposes(s) remains valid after termination of our relationship with you.

Changes to this Online Privacy Statement

We reserve the right to modify this Privacy Statement at anytime without notice. The Privacy Statement posted at any time or from time to time via this Site shall be deemed to be the Privacy Statement then in effect.

Correcting or Updating Your Information

You can help us maintain the accuracy of your personal information by notifying us of any changes to this information. You can correct or update at any time the personal information that you provided and that we maintain on you by accessing the TUI Site and selecting "Account Preferences" from the Main Menu. You can also indicate your preference not to receive promotional email from this screen. TUI is not responsible for and cannot amend the information in your credit report, which is produced by one or more credit reporting agencies. If you believe that some of the information in your credit report is inaccurate, you must contact the applicable credit reporting agency directly.
